These Terms of Use ("Terms") define the conditions under which the SmashScore mobile application ("the App"), published by EURL NGP, may be used, as well as the rights and obligations of users.
Installing and using the App implies full and unconditional acceptance of these Terms.

SmashScore is a mobile scoring app for padel and tennis, available on iOS and Android. It provides:
The App is available for free download from the App Store (iOS) and Google Play (Android). Some features require a paid Premium subscription.
The user is responsible for the compatibility of their device and any internet connection fees required to download and use the App.

The SmashScore Premium subscription unlocks the following features:
Price: €2.99 per month, automatic renewal.
Payment terms: Payment is processed through the user's Apple (App Store) or Google (Google Play) account. Transactions are handled directly by Apple or Google; the publisher has no access to any banking data.
Renewal: The subscription renews automatically every month unless cancelled. Renewal occurs 24 hours before the end of the current period.
Cancellation: The user can cancel the subscription at any time:
Cancellation takes effect at the end of the period already paid for. No prorated refunds are issued.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content delivered without a physical medium when execution has begun after the consumer's prior agreement. By subscribing to Premium, the user expressly waives the right of withdrawal.
SmashScore bracelets are a physical product sold separately at smashscore.fr. Their purchase is governed by the Terms of Sale. The App is compatible with the SmashScore bracelets but can be used without them.
The App, its content, brand, logos, design and source code are the exclusive property of EURL NGP or its partners. Any unauthorized reproduction, representation, modification or exploitation is prohibited and constitutes infringement.
The user retains ownership of the data they enter into the App (player names, scores, etc.).

The publisher does its best to ensure the App functions properly, without however guaranteeing permanent availability or the complete absence of errors. The publisher cannot be held liable for:
The App collects a minimum of data and stores it locally on the user's device. For more information, see our Privacy Policy.
The publisher reserves the right to modify these Terms at any time. Users will be informed of any substantial changes. Continued use of the App after a change constitutes acceptance of the new Terms.
The user may uninstall the App at any time. In case of serious breach of these Terms, the publisher reserves the right to suspend or terminate access to the App.
These Terms are governed by French law. In case of dispute, and after attempting amicable resolution, French courts shall have sole jurisdiction.
In accordance with Article L612-1 of the French Consumer Code, the user may use the free CNPM Médiation Consommation mediation service: cnpm-mediation-consommation.eu
